General Terms
- Acceptance: By accessing or using SkyLens SC (skylens-os.polsia.app), you agree to be bound by these Terms & Conditions and all applicable laws and regulations.
- Eligibility: You must be at least 18 years old to use this platform. By using our services, you represent and warrant that you meet this requirement.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Modifications: We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms. We will update the “last updated” date above when changes are made.
- Governing Law: These terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law principles.
- Entire Agreement: These Terms & Conditions constitute the entire agreement between you and Aerial Photo Imaging LLC with respect to use of the platform.
Consumer Terms (Lead Submitters)
- Free Service: Submitting a photography service request is free of charge. You are never required to pay to request quotes.
- Data Sharing: When you submit a request, your contact information (name, email, phone) and project details are shared with photographers who match your county and service type. By submitting, you consent to this sharing.
- No Guarantee of Response: We do not guarantee that any photographer will respond to your inquiry or fulfill your project. The platform connects you with photographers but does not control their availability or performance.
- Accuracy of Information: You agree to provide accurate and truthful information when submitting a service request. False or misleading submissions may result in removal from the platform and potential liquidated damages as described in Section 5.
- Email Communications: By submitting a request, you consent to receive follow-up emails related to your inquiry (up to 4 messages). You may opt out at any time by contacting us.
- TCPA / SMS Consent: By providing a phone number, you consent to receive SMS messages related to your inquiry. Standard message and data rates may apply. Reply STOP to opt out.
Photographer Terms (Free Registration / Prospects)
- Free Directory Listing: Registering via /register is free and provides a public listing in the photographer directory at /directory.
- Profile Accuracy: You agree all profile information — name, specialties, coverage area, certifications, portfolio URL — is accurate and up to date. Misrepresentation may result in removal and potential liability for damages caused by false credentials.
- Publicly Displayed: Your profile (name, business name, specialties, coverage area, bio, portfolio URL) is displayed publicly on /directory and may be visible to any website visitor.
- No Lead Guarantee: A free listing does not entitle you to lead notifications. Leads go to active paying subscribers first. Free registrants may receive a teaser notification with an upgrade opportunity.
- Upgrade Anytime: You may upgrade to a paid subscription at any time subject to the Subscriber Terms in Section 4.
Subscriber Terms (Paid Photographers)
- Subscription Tiers: Paid subscriptions are available at three tiers: Starter ($49/month), Pro ($99/month), and Agency ($199/month). Pricing is subject to change with 30 days’ written notice.
- Recurring Billing: Subscriptions are billed monthly on a recurring basis via Stripe. By subscribing, you authorize us to charge your payment method each period until you cancel.
- Cancel Anytime: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods remaining after cancellation.
- Lead Distribution: Leads are distributed automatically by county match (Starter) or statewide match (Pro/Agency) plus specialty alignment. Distribution is automated — we do not manually curate lead assignments.
- No Minimum Lead Guarantee: We do not guarantee a minimum number of leads per billing period. Volume depends on consumer demand in your coverage area.
- Coverage Area: You select county or statewide coverage at registration. Changes may be requested by contacting us and take effect on the next billing period.
- Shared Leads: Leads may be sent to multiple matching subscribers. Exclusive delivery is not guaranteed.
Payment Terms
- Recurring Monthly Billing: First charge occurs at checkout. Subsequent charges occur on the same calendar date each month.
- Payment Processor: All payments are processed by Stripe. We do not store your full card details. Stripe’s terms apply to payment processing.
- Auto-Activation: Your account is automatically activated upon successful payment verification. Lead notifications begin immediately.
- No Refunds for Current Period: Fees are non-refundable for the current billing period, including cancellations mid-period or low lead volume months.
- Deactivation: Cancelled or failed-payment accounts are deactivated and lead notifications cease. A brief grace period may apply at our discretion before deactivation.
- Price Changes: We reserve the right to change pricing with 30 days’ written notice. Changes take effect on your next billing cycle after notice.
Prohibited Conduct
You agree not to engage in any of the following prohibited activities. Violation may result in immediate termination of access and may give rise to civil or criminal liability:
- Scraping & Data Mining: Automated collection, scraping, or data mining of platform content, directories, or lead data without prior written consent.
- Impersonation: Impersonating another person, photographer, business, or Aerial Photo Imaging LLC employee.
- Unauthorized Access: Attempting to gain unauthorized access to any part of the platform, its servers, or connected databases.
- Reverse Engineering: Decompiling, reverse engineering, or otherwise attempting to derive the source code or underlying algorithms of the platform.
- Circumventing Security: Bypassing, disabling, or interfering with any security feature, authentication system, or access control on the platform.
- False Reviews & Submissions: Posting false, misleading, or fabricated reviews, lead submissions, or profile information.
- Spam & Unsolicited Communications: Using platform data to send unsolicited commercial messages or spam to other users or leads.
- Hacking & Malware: Transmitting viruses, malware, ransomware, or any code designed to disrupt, damage, or gain unauthorized access to the platform or its users’ systems.
- Harassment: Harassing, threatening, or intimidating any user, photographer, consumer, or Aerial Photo Imaging LLC employee.
- Illegal Content: Submitting or transmitting content that is illegal, defamatory, obscene, or that violates third-party rights.
- Commercial Exploitation: Commercially exploiting platform content, lead data, or photographer listings without written authorization from Aerial Photo Imaging LLC.
- Interference with Platform: Taking any action that imposes an unreasonable or disproportionate load on platform infrastructure or that interferes with other users’ use of the service.
- Automated Access: Using bots, scripts, or other automated tools to access the platform without express written consent.
- Unauthorized Reproduction: Reproducing, republishing, or redistributing any portion of the platform’s directory, lead database, or proprietary content.
Content License (User Submissions)
By submitting any content to the platform — including but not limited to photographer profiles, portfolio links, bios, specialty listings, lead descriptions, and reviews — you grant Aerial Photo Imaging LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media or format, now known or hereafter developed.
This license is non-terminable after submission and survives any termination of your account or these terms. You represent and warrant that you have all rights necessary to grant this license and that the content does not infringe any third-party rights.
You retain ownership of your submitted content, but you acknowledge that Aerial Photo Imaging LLC may use it in connection with the platform’s operations, marketing, and business activities without further compensation to you.
Intellectual Property
- Platform Content: All platform content — design, copy, code, branding, structure, directory data, and compiled lead data — is owned by Aerial Photo Imaging LLC and protected under applicable intellectual property laws. Unauthorized reproduction is prohibited.
- No Transfer: Nothing in these terms transfers ownership of any intellectual property to you, or your intellectual property to us, except as expressly set forth in the Content License above.
- Trademarks: “SkyLens SC,” “Aerial Photo Imaging,” and associated logos are trademarks of Aerial Photo Imaging LLC. You may not use them without prior written permission.
Privacy & Data
- Consumer Data Collected: Name, email, phone, county, service type, and project details when you submit a request.
- Photographer Data Collected: Name, business name, email, phone, coverage area, county, specialties, bio, portfolio URL, years of experience, and certifications when you register.
- Consumer Data Use: Your contact info and project details are shared with matched active subscribers. We also send a nurture email sequence (welcome + up to 3 follow-ups).
- Photographer Data Use: Profile information is displayed on /directory. Contact info is used for lead notifications and platform communications.
- Data Sharing Scope: Consumer contact details are shared only with active paying subscribers who match the lead. We do not sell personal data to third parties for advertising.
- Opt-Out: To opt out of email communications, contact info@aerialphotoimaging.com. Opting out of lead notifications as a subscriber may require cancellation of your subscription.
- Data Retention: Consumer lead data is retained for 12 months; photographer profile data is retained for 24 months. Upon written request, we will delete your data within 30 days, subject to legal hold obligations.
- Analytics: We collect anonymized pageview data (hashed IP, UTM parameters, conversion events) for platform analytics. This data is not linked to personally identifiable information.
Drone & Specialty Photography Disclaimer
SkyLens SC is a lead marketplace. Aerial Photo Imaging LLC does not employ, supervise, endorse, or certify any photographer listed on the platform. Photographers are independent service providers, not employees, agents, or contractors of Aerial Photo Imaging LLC.
- FAA Part 107 Compliance: Photographers who indicate FAA Part 107 certification represent that they hold a current, valid Remote Pilot Certificate issued by the Federal Aviation Administration. We do not independently verify the accuracy of any certification claim.
- No Credential Verification: We do not verify, confirm, or guarantee the accuracy of any credential, license, insurance claim, or certification stated in a photographer’s profile. It is your responsibility to independently verify credentials before hiring.
- Property Damage Disclaimer: We are not responsible for any property damage, bodily injury, or other loss arising from a drone or photography engagement arranged through the platform. Any such claims are solely between the consumer and the photographer.
- Airspace & Local Regulations: Drone operators are solely responsible for complying with all applicable FAA regulations, local ordinances, temporary flight restrictions (TFRs), and property laws. We make no representation that any listed photographer complies with applicable regulations.
- Insurance: We do not guarantee that any photographer carries insurance. Consumers are advised to confirm insurance coverage directly with their photographer before any engagement.
Limitation of Liability
- Marketplace Only: SkyLens SC is a lead marketplace and connection platform. We are not a photography agency, contractor, or employer. We do not perform photography services.
- No Service Quality Warranty: We make no representations about the quality, reliability, or fitness of any photographer listed. Engagements between consumers and photographers are entirely their own arrangements.
- Disputes Between Parties: Disputes arising from photography engagements are solely between the consumer and photographer. Aerial Photo Imaging LLC is not a party to those agreements and assumes no liability.
- Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE TOTAL FEES PAID BY THAT USER IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Warranty Disclaimer
Indemnification
You agree to indemnify, defend, and hold harmless Aerial Photo Imaging LLC and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms & Conditions;
- Your submission of false, misleading, or inaccurate content to the platform;
- Your infringement of any third-party intellectual property right;
- Any willful misconduct, negligence, or harmful conduct by you in connection with the platform;
- Any dispute between you and another user (photographer or consumer) arising from a service engagement;
- Your violation of any applicable law, regulation, or third-party right.
Aerial Photo Imaging LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such claims.
Liquidated Damages
The parties acknowledge that actual damages for certain violations would be difficult to ascertain. Accordingly, you agree that the following liquidated damages are reasonable estimates of harm and not penalties:
- Policy-Violating Content: $1,000 per item for each piece of content submitted in violation of Section 6 (Prohibited Conduct), including but not limited to false reviews, false lead submissions, or content that violates applicable law.
- Unauthorized Data Scraping: $100 per record for each consumer, photographer, or lead record accessed, copied, or reproduced through scraping, automated access, or any unauthorized method in violation of Section 6.
- Unauthorized Reproduction: $100 per record for each instance of unauthorized reproduction or redistribution of platform directory data or lead database records.
These liquidated damages are in addition to, and do not limit, any other remedies available to Aerial Photo Imaging LLC under law or equity, including injunctive relief.
DMCA & Copyright Policy
Aerial Photo Imaging LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

A valid DMCA takedown notice must include: (1) an electronic or physical signature of the copyright owner or authorized agent; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material to be removed with sufficient detail for us to locate it; (4) your contact information; (5) a statement that you have a good faith belief the use is not authorized; and (6) a statement under penalty of perjury that the information in the notice is accurate and you are authorized to act on behalf of the copyright owner.
If your content was removed due to a DMCA notice you believe was in error, you may submit a counter-notice to our DMCA Agent including: (1) your signature; (2) identification of the removed content and its prior location; (3) a statement under penalty of perjury that you have a good faith belief the content was removed in error; (4) your name, address, and phone number; and (5) consent to jurisdiction of the federal district court for your location. Upon receipt of a valid counter-notice, we may restore the content after 10–14 business days unless the complaining party seeks a court order.
We will terminate accounts of users who are repeat copyright infringers in appropriate circumstances.
Interactive Computer Service / Section 230
SkyLens SC is an interactive computer service as defined by 47 U.S.C. § 230. Aerial Photo Imaging LLC is a passive conduit that provides a neutral platform for connecting consumers seeking photography services with independent photographers.
We do not create, edit, or take responsibility for content submitted by users — including photographer profiles, portfolio links, lead descriptions, reviews, or any other third-party content. Users are solely responsible for content they submit to the platform. We are not liable for any user-generated content, and we retain discretion to remove content that violates these terms without thereby assuming responsibility for content we do not remove.
Nothing in these terms shall be construed to treat Aerial Photo Imaging LLC as a creator, developer, or responsible party with respect to user-generated content for purposes of any federal, state, or local law.
Dispute Resolution & Binding Arbitration
Before initiating any arbitration or legal proceeding, you must first provide Aerial Photo Imaging LLC with written notice of your dispute (“Notice of Dispute”) by sending a letter to: Aerial Photo Imaging LLC, Garner Ln Unit 203, Columbia, SC 29210, or by email to info@aerialphotoimaging.com. The Notice of Dispute must describe the nature and basis of the claim and the relief sought. The parties agree to attempt in good faith to resolve the dispute informally for a period of thirty (30) days from the date of receipt of the Notice of Dispute before proceeding to arbitration.
If the dispute is not resolved within 30 days through informal negotiation, you agree that any dispute, claim, or controversy arising out of or relating to these Terms & Conditions or the platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Columbia, South Carolina, unless the parties agree otherwise. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Any claim must be brought within the applicable statute of limitations under South Carolina law. No claim may be brought more than one (1) year after the claimant knew or should have known of the basis for the claim, to the extent permitted by law.
Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims for intellectual property infringement may be brought in court without first proceeding to arbitration.
Class Action Waiver
Termination
- Our Right to Terminate: We may suspend or terminate any account or access at our discretion, with or without notice, for violation of these terms or any other reason we deem appropriate.
- Violations: Grounds for termination include: false information, harassment, misuse of lead data, scraping, unauthorized access, circumventing payment, or illegal activity.
- Effect of Termination: Access ceases immediately upon termination. No refund for prepaid period. Your profile is removed from the public directory.
- Survival: Sections 7 (Content License), 8 (Intellectual Property), 11 (Limitation of Liability), 12 (Warranty Disclaimer), 13 (Indemnification), 14 (Liquidated Damages), 17 (Arbitration), 18 (Class Action Waiver), and 20 (Governing Law) survive any termination of these Terms & Conditions.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of South Carolina, United States of America, without regard to its conflict-of-law provisions. Subject to the arbitration agreement in Section 17, you consent to the exclusive jurisdiction of the state and federal courts located in Richland County, South Carolina for any disputes not subject to arbitration.
Severability
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision or any other jurisdiction. The remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable, or, if such modification is not possible, severed from these terms.
The parties agree that the unenforceability of any provision shall not be grounds for terminating or avoiding the remaining provisions of these Terms & Conditions.
Feedback & Unsolicited Submissions
If you submit any feedback, ideas, suggestions, feature requests, or other submissions to Aerial Photo Imaging LLC (collectively, “Feedback”) — whether through the platform, email, social media, or any other channel — you hereby assign and grant to Aerial Photo Imaging LLC a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, distribute, and commercialize such Feedback without any obligation of compensation, attribution, or confidentiality to you.
You acknowledge that Aerial Photo Imaging LLC has no obligation to treat Feedback as confidential, to acknowledge receipt, or to implement any suggestion. By submitting Feedback, you represent that you have the right to do so and that the Feedback does not violate any third-party rights.
California Users — Civil Code § 1789.3 Notice
Pursuant to California Civil Code § 1789.3, California residents are entitled to the following specific consumer rights notice:
- Service Provider: Aerial Photo Imaging LLC, Garner Ln Unit 203, Columbia, SC 29210.
- Service: SkyLens SC is a free-to-consumer photography lead marketplace platform. Photographers pay subscription fees of $49–$199/month.
- Complaint Resolution: To resolve a complaint regarding the service or to receive further information regarding use of the service, you may contact us at info@aerialphotoimaging.com or by mail at the address above.
- California DCA: You may also contact the Complaint Assistance Unit of the Division of Consumer Affairs of the Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
